1. Who we are
FinKidz Academy is operated by Dr Meiya Gert Nthoesane T/A FinKidz ("we", "us", "the seller"), 193 Yellowfish Lane, Aquavista Mountain Estate, Bronkhorstspruit, South Africa, 1020. When you use this website or purchase access to the programme, you are contracting with Dr Meiya Gert Nthoesane T/A FinKidz.
2. Acceptance of these terms
By continuing to use the FinKidz Academy website and services, you agree to these Terms & Conditions. If you do not agree, please do not use the service. Parents and guardians create accounts and enrol children; by doing so you confirm you are of legal age and, where applicable, have authority to act for the child you enrol.
3. The service
FinKidz Academy is an educational financial-literacy programme for children aged 8–14, delivered over 52 weekly lessons with quizzes, activities and a parent dashboard. It is an educational programme only: we are not a bank, financial adviser or investment service, and nothing on the site is financial, investment, legal or tax advice. Activities use fictional money and adult-supervised projects.
4. Acceptable use
You must not misuse the service. In particular, you must not:
- use the service for anything unlawful, fraudulent or deceptive;
- send spam or infringe anyone's intellectual property rights;
- introduce malware, probe or scan our systems, or scrape the site;
- reverse engineer, resell, redistribute or circumvent technical limits of the service;
- share your account credentials or allow unauthorised access.
You are responsible for keeping your account credentials confidential and for all activity under your account, and for providing accurate information and keeping it up to date.
5. Intellectual property
We retain ownership of the service and all its intellectual property, including the software, lesson content, workbook materials, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service for your enrolled children within your selected plan.
6. Payments, billing and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms). We offer a monthly subscription and a once-off payment option; details and prices are shown on the parent dashboard before you pay.
7. Service level
We work hard to keep the service available, but we do not guarantee uninterrupted or error-free performance. The service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
8. Suspension and termination
We may suspend or terminate access to the service for material breach of these terms, non-payment, security or fraud risk, or repeated or serious violations of our policies. When access ends, your children's progress records are handled as described in our Privacy Notice.
9. Liability
To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow it.
10. General
These terms are governed by the laws of South Africa, and disputes will be heard in the South African courts. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control.
